Committee calls for evidence on Advocates’ delay in Civil Proceedings

Tynwald resolved on 22nd February 2012 that a Select Committee of three Members be appointed with powers to take written and oral evidence under Sections 3 and 4 of the Tynwald Proceedings Act 1876, as amended, to examine the reasons for delays and deficiencies in respect of case management with regard to Civil Legal Proceedings, and to report with recommendations to the October 2012 sitting of Tynwald Court.

The Members appointed to the Committee by Tynwald were Mr John Houghton MHK (Chairman), Mrs Brenda Cannell MHK, and Mr Tony Wild MLC.

The Committee wishes to give members of the public the opportunity to submit a short summary of their experience of deliberate time wasting by advocates in order to boost their fees, with examples of advocates’ pointless delaying letters. The Committee will not re-open any cases on their merits, but will only focus on the process of the preparation of cases between issuing of proceedings and the date of the trial.

Submissions should be sent to the Clerk of the Committee by Wednesday 16th May 2012.

It will be assumed that respondents are content for their response to be published unless otherwise indicated.
