Health Minister David Anderson, not Eddie Teare, will take charge at the Department of Education for the next few days.
Mr Teare had initially been appointed as successor to the sacked Peter Karran as an interim measure.
However, it was realised the Government Departments Act 1987 prohibits treasury members from holding other departmental positions.
