TUPE or not TUPE?

There are no immediate plans on the Island to consider introducing legislation which helps protect employees rights.

TUPE - Transfer of Undertakings Protection of Employment - regulations are currently being reviewed in the UK by the Department of Business, Innovation and Skills.

They were first implemented after a 1977 European Council Directive but some businesses are concerned that the legislation is over bureaucratic and provides 'gold plated' protection for employees.

Speaking in the House of Keys, Economic Development Minister John Shimmin said a current review of employment legislation didn't have consideration of TUPE as one of its priorities, although he wouldn't rule out considering it at some stage in the future.
