Minister delighted worker's 'ordeal is over'

by isleofman.com 26th April 2010

Safety rules for roadworks in the Isle of Man may be reexamined, after criminal proceedings against a worker with the former Department of Transport, accused of manslaughter, were dropped.

Sixty-three-year-old Brian Tomlinson was charged with manslaughter by gross negligence over the death of a visiting motorcyclist in May 2007.

He was accused of failing to place warning signs in the correct position, near roadworks at the Verandah on the Mountain Road.

Biker Alan Osborne died when he ran into a truck which had stopped at the roadworks.

On Friday, Mr Tomlinson from Glen Vine walked free from Douglas courthouse after the prosecution accepted a 'not guilty' plea.

Responsibility for the Island's roads now falls under the remit of the Department of Infrastructure, and Minister Phil Gawne says he and his colleagues will be studying the court ruling to see if there are lessons to be learned:
