Defendant in manslaughter case found not guilty

A worker with the former Department of Transport has walked free from court, after being found not guilty of the manslaughter with gross negligence of a visitor to the TT in 2007.

Sixty-three-year-old Brian Tomlinson, of Glen Vine, was prosecuted after the death of Alan Osborne, from Kent.

Mr Osborne suffered fatal injuries in a head on collision at road works on the Veranda section of the Mountain Road in May of that year.

Mr Tomlinson, who pleaded not guilty to the manslaughter charge, was accused of failing to properly give motorists advance warning of the works.

But a verdict of not guilty was accepted by the prosecution, and despite admitting a breach of the Health and safety at Work Act, Mr Tomlinson was given an absolute discharge by Deemster Moran.

On Mandate PM, Mr Tomlinson's advocate Richard Halsall told Marian Kenny it became clear Mr Osborne's riding had been to blame (play extended audio file):
