'Lenient sentence' in GBH case

A 27-year-old man who battered another outside a Douglas takeaway, breaking his jaw, has been jailed for 18 months.

Lee James McSween, of Ashley Park in Onchan, admitted inflicting grievous bodily harm with intent on Douglas Gardner.

The attack happened outside Moby Dick's chip shop on Douglas promenade, at around 3am on July 3 last year.

The court heard the pair exchanged words, then Gardner pushed hot food into McSween's face.

McSween then punched Gardner and he fell to the ground, where McSween kicked him.

Gardner was taken to Noble's Hospital with severe facial injuries, including a fractured jaw, and underwent surgery.

Deemster Doyle said despite the severity of the injuries, and the fact the incident occurred in a public place, he was imposing a lenient sentence.

This was after receiving many glowing references about McSween, and the very strong mitigation which had been presented.
