Burj Dubai mentioned in judgement

Deemster Doyle says without fresh and mature thinking, the world’s tallest building will be finished before a house in central Douglas.

He threw out a claim from the building’s owner against the Department of Local Government and the Environment, over a Health and Safety notice issued in 2006.

The prohibition notice stopped building work at number 2 Mona Terrace, but owner Ian Abrahams didn’t appeal against it.

Instead, he took out a petition of doleance against DoLGE trying to overturn it.

Mr Abrahams argued the notice had been issued in bad faith, his human rights had been affected by it, and he had been too late to appeal after trying to comply with it.

But in his judgement, Deemster Doyle said claims of bad faith and breaches of human rights were hopelessly vague.

He dismissed the application, and said Mr Abrahams should have used the Health and Safety tribunal to appeal against the notice earlier.

He added it wasn’t in anyone’s interest to see the property stagnate, and unless agreement could be found the 800-metre high Burj Dubai would be finished before the house on Mona Street.
