Council's court clash with Gubay company

Liverpool City Council has had a slap on the wrist from a High Court judge in a legal battle with multi-millionaire businessman Albert Gubay, who has strong connections with the Isle of Man.

Mr Gubay’s company Derwent Holdings went to court over a new traffic system in Edge Lane, saying the council hadn’t properly consulted with it over a traffic regulation order made in 2006.

Derwent owns 100 acres of land nearby and wants to build a ?200m retail and leisure park, but faces stiff opposition from the council over the scale of the project.

Mr Justice Collins refused to overturn the order but said the council’s publicity was insufficient, and the local authority did as little possible to comply with the law.

Afterwards a spokesman for Derwent Holdings said the company was happy with the outcome, and hoped the ruling would mean more cooperation with the council in the future.
