Divorce case goes ahead

A row between a divorced couple over money will be heard in court, after Deemster Kerruish refused to strike out the case.

Advocates for Colin Forster argued Deborah Forster’s claims were an abuse of process because she’d offered no evidence.

She claimed her ex-husband had stopped paying her half of his bonus pay nine years after they divorced.

But Mr Forster denied he’d agreed the payments and had stopped receiving any bonuses three years ago.

Mr Forster’s advocate said she had affidavits showing he hadn’t received bonus pay for three years, and had made three years of ex-gratia payments. She argued the case should be thrown out because there was no basis for a claim against him.

But Mrs Forster said she intended to challenge the defence evidence and Deemster Kerruish said he couldn’t rule the claim vexatious or frivolous.

He said the case could go ahead but warned Mrs Forster could end up paying both sets of costs if she lost the claim.
