Fatal accident trial continues

by isleofman.com 31st October 2007
A court has been told how a Foxdale woman admitted to a police officer she was responsible for an accident in which a Port Erin man was killed.

Patricia Power, of the Eairy, East Foxdale, is alleged to have made the comment at the scene of the crash in which 47 year-old painter and decorator John Hughes lost his life.

The trial of Mrs Power, who denies driving without due care and attention on the Ballamodha Straight last November, is continuing at Douglas courthouse.

James Davis reports (text, below, from attached audio file):

The court heard a written statement from PC Faith Cooper who attended the scene of accident and spoke to Mrs Power.

PC Cooper said Mrs Power turned to her and said: ‘It’s my fault, I was just passing a car in front.

‘I saw the bike before I overtook the car but he was going quicker than I realised. It was my fault. I don’t think he was doing anything wrong.

‘There was no possibility of me breaking and going back behind the car. I accelerated to try and get past it.’

Following those comments, Mrs Power was arrested and charged with causing death by dangerous driving and cautioned.

The charge was later downgraded to driving without due care and attention.
