Juvenile gives video evidence

A juvenile who heard an accident in which a Port Erin motorcyclist lost his life has been giving evidence at Douglas courthouse.

Forty-seven year-old painter and decorator John Hughes was killed on the Ballamodha Straight last November, and Patricia Power, of the Eairy, East Foxdale, is on trial accused of driving without due care and attention.

The case is being heard by Magistrates, who earlier today visited the scene of the accident, along with representatives of the prosecution and defence.

The juvenile, who can’t be named, gave evidence via a video-link, and described seeing a bike coming down the Ballamodha and trying to overtake what was thought to be a Land Rover 4x4.

The juvenile said the motorcyclist pulled back until a car coming in the opposite direction had passed by, before then overtaking.

A few seconds later, the witness heard a screech and a bang.

The juvenile later broke down under cross-examination by Mrs Power's advocate, which led to a 20 minute delay.

When the court resumed the defence advocate was reminded of the witnesses’ age and asked to adopt a softer tone and make the questions simpler.

The trial is continuing.
