Family fortunes in court

Deemster Doyle has said it’s unfortunate a family argument about money should have been aired in a courtroom.

He was giving judgment in a ?50,000 row between the son and daughter of the late Jonathan Allan Cain and his sister.

Rachelle Louise Cain and Jonathan Allan Cain said they were entitled to have the cash paid to them as their late father had loaned the money to his sister.

But Stella Christina Crellin said the loan had been written off before her brother died.

Mr Cain was said to have lent the money to his sister in March 2005 so she could buy a property but in August that year – just a month before he died – he told her he didn’t want the money back.

His children, however, denied her evidence and said the loan hadn’t been written off and she should pay the money back.

Deemster Doyle said the case was unfortunate and had generated quite an amount of ill-feeling within the family.

But he said he believed Mrs Crellin and ruled the money was rightfully hers.
