Cubbon - supply charge dismissed

A charge against a man who was alleged to have supplied heroin to a young woman has been dropped.

Nadine Smith died whilst in care, after taking an overdose.

The charge against 28 year old Michael Darren Cubbon was dismissed by the court because the prosecution offered no evidence. However he was given a three month prison sentence after admitting one offence of possessing heroin.

Linda Watt, prosecuting, said police searched the defendant's home on December the second 2005 where they found a wrap of brown powder containing 89 milligrammes of powder with 43% of heroin.

The defendant was arrested and he told police it was his. His advocate Paul O'Neill said the defendant was remorseful for his past behaviour and was sorry for the stress he caused his family. He was now clear of drugs and was determined to remain off them.

Deemster Montgomery said heroin was a pernicious drug. He noted Cubbon had a conviction for a conspiracy to supply heroin in 2002 for which he was given a substantial jail sentence.
