Heyes inquest

by isleofman.com 13th February 2007
Coroner Michael Moyle recorded a verdict of accidental death on a 39 year old TT marshal, when an inquest into his death resumed on Saturday.

Martin Stuart David Heyes of Port Soderick, died of multiple injuries sustained after being involved in an accident with a Suzuki scooter on the main Douglas to Peel road at the entrance to Kerrowgarroo Lane on September 1st.

It has been reported by a marshal that there were spots of mud on the road, resulting in a travelling marshal, Anthony Duncan, attending. He parked his bike parallel in the lane but off the road, leaving space either side for motorcycles to access the lane.

Phillip Geoffrey Granby, who was riding the Suzuki scooter, was with friends and had a pillion passenger. He told the hearing that he approached the lane from the Peel direction, indicated and started to turn, but as he was all but in the lane he was hit by a motorcycle coming from the direction of Douglas. He and his passenger were thrown into the air and both sustained injuries.

Several witnesses said they had heard a motorbike coming very quickly from the Douglas direction, and Mr Duncan said he was aware of a bike approaching at high speed but it did not ring alarm bells with him. He saw the scooter in the lane and it was hit by the motorcyclist who was heading straight towards the gate past the cottage. Everything happened in a flash, but he thought the rider applied his brakes. Had he not hit the scooter he would have hit the wall as the brakes had locked and he could not change direction.

Another witness, Andrew Atkinson, said that Mr Granby had almost completed his turn into the lane when all of a sudden he saw a bike coming "at a fair rate of knots". The rider sat up and applied both brakes and he saw blue smoke coming from the tyres. The bike did not deviate.

PC Peter Dyers said he could not give an accurate speed for the motorcyclist . . but from the reconstruction the bike could have stopped at 74 miles per hour.

Recording his verdict Mr Moyle said he was not there to criticise anyone. Both Mr Duncan and Mr Granby had told the court that there had not been any criminal proceedings .. and none were pending.

Appearing for the organisers of the MGP, Neil Hanson said Mr Heyes was a well-liked and popular Marshal, and he would be very sadly missed.
