Cleared of unlawful assault

by isleofman.com 12th January 2007
A part-time site agent for an Isle of Man property developer has been cleared of unlawfully assaulting man in West Cumbria.

Roy Fowler, 46, had been charged with causing actual bodily harm to Keith Allard but the jury at Carlisle Crown Court took an hour to return a unanimous not guilty verdict.

Mr Fowler admitted punching Mr Allard three times in the face but said he did it in self-defence.

The court heard a row broke out in September last year, when Mr Fowler was working on a farm site redevelopment.

Mr Fowler started arguing with 74-year-old farmer Jim Dawson over access to farmland and attacked Mr Allard when he went to intervene.

Mr Fowler said he’d already been assaulted by Jim Dawson and called the police before Mr Allard arrived.

Fowler said he punched Mr Allard three or four times, and was punched by him at least twice.

Mr Dawson stamped on his hand causing two broken bones which had to be mended with metal pins.
