Braddan Commissioners in legal threat

Braddan Commissioners and their Clerk, Charles Lewin, could find themselves in court for failing to comply with the recommendations of a public inquiry.

A Tynwald backed demand that ?23,000, paid to staff as part of a pensions scheme, should be reclaimed for the benefit of Braddan ratepayers, was disregarded by the board.

It was revealed 20 of the 25 recommendations, which came out of the inquiry, had already been implemented.

The outcome of the debate was that the commissioner's auditors are to make an application to the Court under the Audit Act for a declaration that the overpayments were contrary to law.

If the commissioners fail to comply, the matter will be taken to the High Court.

Earlier today, Local Government Minister John Rimington told Tynwald he was withdrawing the draft Braddan area plan and starting the process again.
