Legal arguments held 'in camera'

by isleofman.com 3rd October 2006
The future of the Julie Corkill trial will be revealed tomorrow after High Bailiff Michael Moyle heard applications behind closed doors.

After key prosecution witness Will Kelly fell ill earlier this week, the defence and prosecution argue about whether the trial can now go ahead.

Prosecution advocate Stuart Neale claimed there was enough evidence to press on with some charges without having Mr Kelly at the hearing.

Jason Roberts reports.

In a stop-start hearing, the court was told Mr Kelly would be unable to continue with his evidence for at least six months, which Mr Moyle said would appear to be a permanent incapacity.

He asked both sets of advocates for suggestions, at which point Mr Neale said some charges could still stand.

But Defence advocate Dawn Jones (pictured, right, with Mrs Corkill) said she had documents which she could show to Mr Moyle and the prosecution but which she didn’t want aired in public yet.

As a result, Mr Moyle ordered the hearing to be held in camera – without public or press present.

The trial will resume tomorrow, when Mr Moyle said it was likely some charges will proceed.
