Gubay not too ill to give evidence, says court

Island businessman Albert Gubay may yet have to give more evidence in a case involving a former employee.
Peter Willers and Mr Gubay have been fighting a long-running legal battle over claims Mr Willers was promised payments he never received.
Mr Willers claims he’s owed more than ?5million under verbal agreements made before his dismissal in 2009 – Mr Gubay says no such promises were made.
Now, Deemster Corlett has ruled Mr Gubay is well enough to continue giving evidence if necessary after a doctor who produced a report about his ill-health was himself too unwell to attend court.
Deemster Corlett said because Dr Keith Rix’s report contained factual errors about Mr Gubay’s medical history, it was important to have him in court to answer questions from advocates – and because he’s too ill to appear, his evidence may not be adduced in the case.
Mr Gubay’s advocates had also applied to have him released from the case and excuse him from further cross-examination because of his ill health.
But Deemster Corlett said although the 87 year old was suffering from some forgetfulness due to his age, he was still well enough to give evidence in person.
He dismissed the application, noting Mr Gubay still works six mornings a week monitoring his property developments.
