Irvings face ?97,000 court costs

Two men behind the construction company Street Heritage have been ordered to pay around ?100,000 in court costs.

Jonathan Irving and his son Jamie Irving had sued the Island’s Attorney General Stephen Harding, his predecessor William John Corlett QC, the government’s Chief Financial Officer Malcolm Couch, former Deputy Assessor of Income Tax Colin Goodwin and former Chief Secretary Mary Williams.

In their case, they claimed their company had been wrongfully wound up over its ?180,000 debts to the government.

But their ?3.5 million claim was struck out in 2011 and they exhausted all avenues of appeal in November last year.

The court had ordered the Irvings to pay the costs of their four opponents in the case, totalling ?97,240.

The two men had applied for enforcement to be delayed, saying other litigation was going ahead against their former advocate Jerry Carter and the Treasury and the costs orders should wait until after those cases had been heard.

But Appeal Judge Tattersall and Deemster Storey said they could see no special reason why the enforcement should be delayed, and described the other cases as irrelevant.

They ordered the Irvings to pay the court costs.
