Lawyer's clarion call for restoration of AML defence

by isleofman.com 2nd February 2015
An Island law firm says the loss of a key defence in anti money laundering legislation could prove costly for the legal and business sectors.
In 2009 the Manx government removed the adequate consideration defence - which protected firms from prosecution if it was subsequently found they were paid from the proceeds of criminal conduct.
The defence was repealed after a report on the Island's anti money laundering laws by the International Monetary Fund.
Advocate Tom Maher of Douglas-based Dougherty Quinn says the move has serious consequences for many Island firms.
He fears a wide range of business people are at risk of prosecution despite having acted in good faith:
The government says it has heard concerns from the Law Society but has been given no evidence of any problems, in the four years since the defence was removed.
It also rejects the argument that innocent parties could be open to prosecution as a result of the defence being removed. Clip 1
