Question over fixed penalty notice appeals raised in House of Keys sitting

At yesterday's sitting of the House of Keys, Douglas North MHK David Ashford asked the Minister for Infrastructure the reasons as to why more than 15% of fixed penalty notices are successfully appealed.

Minister Harmer advised: "There are a number of reasons why a fixed penalty notice is successfully appealed.

These could range from genuinely unforeseen circumstances such as a broken down vehicle, through to an unmarked vehicle being used by the emergency services.

The Department considers each appeal on its individual merits and the evidence available at the time.

Currently, we do not record the specific reason why a fixed penalty notice is successfully challenged. The Department is, however, reviewing its processing systems with a view to enabling such analysis in the future."
